Selling an Inherited House in Las Vegas: Why the Affidavit Cannot Move a House

Selling an inherited house in Las Vegas, Nevada

Key Takeaways

  • The affidavit cannot touch the house: Nevada's affidavit of entitlement works only when the person who died left no real property in Nevada. It collects personal property worth up to $25,000, or $150,000 for a surviving spouse (NRS 146.080).
  • The 2025 limits are higher: The set-aside now covers estates up to $150,000 net of liens, and summary administration up to $500,000.
  • A probate sale usually goes back to court: Clark County's Probate Commissioners hold a sales calendar, and any buyer's contract is subject to that hearing (NRS 148.270).
  • No Nevada inheritance or estate tax: The state constitution bars an inheritance tax, and the federal basis generally steps up at death.
  • There's no rush to decide: The court sets the pace, and the house can sell as-is once the paperwork allows.

If you need to sell an inherited house in Las Vegas, Nevada, the first question is about title, not price. Nevada has a short affidavit that lets heirs collect a parent's bank account without going to court. It cannot move a house. Until a court order or a recorded deed clears title, there is usually no one who can sign a deed a title company will insure.

This guide covers the paths that clear title, how Clark County confirms a sale, and what an empty house costs meanwhile. It is a lot to carry in a hard season, and none of it has to be settled this week.

Why Can't the Nevada Affidavit Sell an Inherited House?

The Nevada affidavit cannot sell an inherited house because it applies only when the person who died "leaves no real property, nor interest therein, nor mortgage or lien thereon, in this State" (NRS 146.080(1)). A house in Las Vegas is real property. If a parent owned one, the affidavit is closed to the whole estate. The person signing must swear that the estate "does not include any real property" (NRS 146.080(2)(c)).

What the affidavit can do

Where there is no Nevada real property, the affidavit collects personal property worth up to $25,000, or up to $150,000 when the surviving spouse is the claimant (NRS 146.080(7)). Cars registered to the person and amounts due for military service do not count toward the limit. It can be used 40 days after the death. The Clark County Probate Commissioner's synopsis says the affidavit applies only to estates that "have no assets consisting of real property in Nevada" (Synopsis of Nevada Probate Law, revised October 1, 2025).

Five Paths to Clear Title Before You Sell an Inherited House in Las Vegas

Nevada offers five paths after a death, and four of them can convey an inherited Las Vegas house.

Path Dollar Limit Can It Convey the House? Who Signs Statute
Affidavit of entitlement $25,000 of personal property ($150,000 for a surviving spouse) No. It is unavailable if the person left any Nevada real property The heir who signs the affidavit NRS 146.080
Set-aside without administration Estate up to $150,000, net of liens Yes. The court order passes the house to the heirs The heirs named in the order NRS 146.070
Summary administration Up to $500,000 after encumbrances Yes, with notice and court confirmation The personal representative NRS 145.040; NRS 145.070
General administration Over $500,000 Yes, with court confirmation or full independent authority The personal representative NRS chapter 148; NRS 143.380
Deed Upon Death None in the statute Yes, outside probate, if recorded before the death The named beneficiary NRS 111.655 to 111.699

The set-aside for estates up to $150,000

When the whole estate is worth $150,000 or less, the court can set it aside without administration (NRS 146.070(1)(a)). Value means fair market value minus enforceable liens, measured on the date of death (NRS 146.070(17)). The Clark County synopsis says the set-aside "is applicable to both real and personal property."

In an illustrative case, a house worth $380,000 with $260,000 owed has a net value of $120,000. If nothing else pushes the estate past $150,000, a set-aside may fit.

The petition cannot be filed until 30 days after the death (NRS 146.070(8)). Notice of the hearing goes to the heirs, the devisees, and the Nevada Health Authority (NRS 146.070(11)). If a spouse or minor children survive, the court must set the estate aside for them (NRS 146.070(3)).

Summary administration up to $500,000

Summary administration is a shortened probate for an estate worth up to $500,000 after deducting encumbrances (NRS 145.040). Creditors get 60 days to file claims (NRS 145.060). A sale of real property still needs notice and court confirmation under chapter 148 (NRS 145.070).

General administration above $500,000

Larger estates go through general administration, where creditors have 90 days to file claims (NRS 147.040). The house sells under chapter 148, covered below, unless the court grants full independent authority.

When a Deed Upon Death was recorded

A Deed Upon Death passes the house to a named beneficiary when the owner dies, outside probate (NRS 111.671). It is valid only if it was recorded with the county recorder before the owner died (NRS 111.681).

After the death, the beneficiary records a Death of Grantor Affidavit with a copy of the death certificate and a declaration of value (NRS 111.699). The beneficiary also publishes a notice to creditors and mails it to the Nevada Health Authority and known creditors (NRS 111.689(3)). Creditors then have 90 days to file claims.

A beneficiary who sells after those 90 days, with the Health Authority's waiver, has no personal liability for late claims (NRS 111.689(5)). The house passes subject to any liens that existed at the death (NRS 111.691).

What changed on October 1, 2025

Senate Bill 404 of 2025 raised the set-aside ceiling from $100,000 to $150,000 and the summary administration ceiling from $300,000 to $500,000. It also raised the surviving spouse's affidavit limit to $150,000 (SB 404, enrolled bill). If the death came before that date, ask the court or a lawyer which limit applies.

Where Does Clark County Probate Happen?

Clark County probate happens in the Eighth Judicial District Court, where two Probate Commissioners hear estate and trust matters. The probate office is in the Phoenix Building at 330 South 3rd Street, Las Vegas, NV 89101. The District Court Clerk's Office is at the Regional Justice Center, 200 Lewis Avenue, 3rd Floor (Eighth Judicial District Court, Probate).

Probate court sits on Wednesday and Friday mornings, and the sales calendar starts at 9:30 a.m. Its FAQ is plain: "Sales of real property have to be approved by the court before the property is transferred."

Who inherits when there is no will

Without a will, Nevada's intestate rules decide who inherits a parent's separate property. A surviving spouse and one child each take one-half. A spouse with two or more children takes one-third, and the children share the rest (NRS 134.040).

Community property follows its own rule (NRS 134.010). The surviving spouse already owns half, and the other half passes by will or, without one, to the spouse (NRS 123.250).

How Does a Nevada Probate House Sale Get Confirmed?

A Nevada probate house sale is confirmed at a court hearing after the personal representative signs a contract and files a return of sale within 30 days (NRS 148.060). No title passes until the court confirms the sale, even when the will authorizes it (NRS 148.080).

Notice and value

Notice of the sale is published three times over two weeks unless the court waives it (NRS 148.220). The court can waive publication when the heirs or devisees consent in writing. A public listing of at least 30 days can also qualify.

The court must be satisfied that the price represents fair market value, with an appraisal from within the past year (NRS 148.260). With every heir's written consent, the court can waive the appraisal and rely on the assessed value for taxes.

What happens at the hearing

At the hearing, the court checks that the sale was legally made and fairly conducted (NRS 148.270). A responsible person can present a higher offer at the hearing. On a contract price of $100,000 or more, it has to exceed that price by at least $5,000. Below $100,000, it has to be at least 5 percent more.

If the court accepts a higher offer at the hearing, it substitutes the new price and buyer into the original contract, and escrow closes on that order (NRS 148.270(5)). Any buyer's contract, including a cash contract with Propcash, is subject to that hearing. The personal representative then signs a deed that refers to the order, and a certified copy is recorded with the county recorder (NRS 148.280).

Independent administration

A personal representative can ask the court for full authority under Nevada's Independent Administration of Estates Act (NRS 143.340). With full authority, the house can be sold without court confirmation or a published notice of sale (NRS 143.380). The heirs and devisees still receive a notice of proposed action, with the price and terms, at least 15 days before the sale (NRS 143.730). If the price is under 90 percent of the appraised value, every interested person must consent in writing, and the court must confirm the sale (NRS 143.380(4)).

From Death to Closing: The Steps and the Statutes

An administered Las Vegas estate sale moves from petition to letters, creditor notice, contract, and confirmation, and a Nevada statute governs each step.

Step What Happens Governing Law
1. The death The affidavit is closed to any estate with Nevada real property NRS 146.080(1)
2. Day 30 Earliest date to petition for a set-aside on an estate up to $150,000 NRS 146.070(8)
3. Petition for letters Filed in the Eighth Judicial District Court, with notice at least 10 days before the hearing NRS 145.020; NRS 155.010
4. Letters issued The personal representative is appointed, with or without independent authority NRS 143.340
5. Notice to creditors Claims due within 60 days in summary administration, or 90 days in general administration NRS 145.060; NRS 147.040
6. Contract and notice of sale Published three times over two weeks, unless the court waives it NRS 148.220
7. Return of sale Report and petition filed within 30 days of the sale, with notice of the hearing NRS 148.060
8. Confirmation hearing The court confirms the sale, or accepts a higher offer at the hearing NRS 148.270
9. Closing and recording The deed refers to the order, a certified copy is recorded, and transfer tax is paid at recording NRS 148.280; NRS chapter 375

The table shows order, not a promised calendar. The probate office can tell you where a particular estate stands.

Does an Estate Fill Out Nevada's Seller Disclosure Form?

A personal representative or trustee selling for someone who has died may be exempt from Nevada's seller disclosure form. NRS 113.130(2)(e) exempts a sale by a fiduciary "who takes temporary possession or control of or title to the property solely to facilitate the sale of the property on behalf of a person who is deceased or incapacitated."

Without an exemption, the seller completes the form and serves it at least 10 days before the house is conveyed (NRS 113.130(1)(a)). The buyer cannot waive that duty, and the seller cannot require a waiver (NRS 113.130(3)).

Heirs who sell in their own names, after a set-aside order or a Deed Upon Death, are a different case. The exemption list covers sales between co-owners, spouses, or close relatives (NRS 113.130(2)(b)). It does not list an heir's sale to an outside buyer. Selling as-is takes repairs off the list, and the form still applies.

Taxes on an Inherited Las Vegas House

An heir owes no Nevada inheritance or estate tax on a Las Vegas house. The Nevada Constitution says "No inheritance tax shall ever be levied" (Nevada Constitution, Article 10, Section 1). The Nevada Department of Taxation requires no estate tax filing for deaths on or after January 1, 2005.

The stepped-up basis

For federal income tax, an heir's basis is generally "the fair market value of the property at the date of the decedent's death" (26 U.S.C. 1014(a)(1)). If the house sells for close to that value, there may be little taxable gain.

Because Nevada is a community property state, 26 U.S.C. 1014(b)(6) can also step up the surviving spouse's half. A tax professional can confirm how that applies.

The transfer tax at recording

Clark County collects real property transfer tax of $2.55 per $500 of value when a deed is recorded (Clark County Recorder). On an illustrative $470,000 sale, that comes to $2,397. The purchase contract says which side pays it.

Older Houses Near Downtown and in Sun City Summerlin

Inherited Las Vegas houses range from 1930s cottages near downtown to houses in the 55-plus community of Sun City Summerlin.

The Zillow Home Value Index for ZIP 89106, which includes the Historic Westside, was about $335,973 in August 2026, down 3.1% over the year. For ZIP 89134, it was about $486,438, down 3.5% (Zillow ZHVI, August 2026). Those are ZIP figures, not neighborhood ones.

Houses this age can carry original wiring, old evaporative coolers, and put-off maintenance. None of it has to be fixed before a sale. As-is means as-is.

Selling an Inherited Las Vegas House From Out of State Without Rushing

An heir in another state can sell an inherited Las Vegas house without moving back, because the work is mainly court paperwork and an escrow closing.

The house full of belongings

An inherited house often comes with a lifetime of furniture, papers, and photographs, and sorting it from another state can take months. A direct cash sale can work differently: Take what you want, leave the rest.

What the wait costs

While the estate moves, HOA dues continue in a planned community, and an empty house still needs power through a Las Vegas summer. Unpaid assessments can turn into a lien, which our guide to HOA liens and foreclosure in Las Vegas explains.

Las Vegas Realtors reported a $470,000 median for existing single-family houses sold in Southern Nevada in September 2026, flat over the year (Las Vegas Realtors, September 2026). The sales pace equaled a five-month supply of houses, up from roughly four months a year earlier.

By the end of September, 7,995 single-family houses were listed without an offer, up 6.6% over the year (Las Vegas Realtors, September 2026). Our Las Vegas housing market 2026 report has more.

Listing or a direct cash offer

If the house shows well and the estate has time, listing with an agent may net more. If you would rather skip repairs, showings, and the cleanout, a direct cash offer is another option. Propcash is a direct cash homebuyer that buys as a principal, with no fees or commissions to the seller. You can get a cash offer from Propcash on the house as it stands, with the reasoning shown. If a cash sale isn't the right fit, we'll tell you.

The offer stands while the court paperwork moves. The closing follows the court's order or the recorded Death of Grantor Affidavit, and you pick the date from there. There's no rush to decide. Our inherited house guide and the Las Vegas cash offer page show how that works, and our Nevada page covers the rest of the state.

Can the Nevada small estate affidavit transfer an inherited house in Las Vegas?

The Nevada small estate affidavit cannot transfer an inherited house in Las Vegas. Under NRS 146.080, it is available only when the person who died left no real property in Nevada. It collects personal property worth up to $25,000, or $150,000 for a surviving spouse. A house needs a set-aside order, a court-supervised sale, or a recorded Deed Upon Death.

Does an heir need probate to sell an inherited house in Las Vegas?

Selling an inherited Las Vegas house usually takes a court process, unless the owner recorded a Deed Upon Death before dying. An estate worth $150,000 or less after liens may qualify for a set-aside under NRS 146.070, and one worth up to $500,000 may qualify for summary administration under NRS 145.040. Larger estates go through general administration in the Eighth Judicial District Court.

How does a Nevada probate house sale get approved in Clark County?

A Nevada probate house sale in Clark County is approved at a confirmation hearing before the Probate Commissioners. The court checks the price against fair market value and may accept a higher offer at the hearing (NRS 148.270). With full independent authority, a personal representative can sell without confirmation after a 15-day notice of proposed action.

What happens if a parent recorded a Deed Upon Death on a Las Vegas house?

A Deed Upon Death recorded before the owner died passes the Las Vegas house to the named beneficiary without probate. The beneficiary records a Death of Grantor Affidavit with a copy of the death certificate under NRS 111.699, then publishes a 90-day notice to creditors under NRS 111.689. The house passes subject to any liens that existed on the date of death.

An heir owes no Nevada inheritance tax on a Las Vegas house, because Article 10, Section 1 of the Nevada Constitution says no inheritance tax shall ever be levied. The Nevada Department of Taxation requires no estate tax filing for deaths on or after January 1, 2005. For federal income tax, an heir's basis is generally the house's fair market value at the date of death under 26 U.S.C. 1014.

Does an inherited Las Vegas house have to be cleaned out or repaired before it sells?

An inherited Las Vegas house does not have to be cleaned out or repaired before it sells. It can sell as-is, belongings and all, when the buyer agrees to take it that way. With a direct cash offer from Propcash, the family can take what they want and leave the rest. The closing follows the court's paperwork, so there's no rush to decide.
