To sell an inherited house in Lake County, Florida, the estate is opened with the Lake County Clerk of Court's probate section at the courthouse in Tavares. Estates of $150,000 or less, or deaths more than two years ago, can use summary administration. Larger estates appoint a personal representative, who can often sell the house before probate closes.
Key Takeaways
- The summary threshold doubled in 2026. Chapter 2026-57, Laws of Florida, raised summary administration from $75,000 to $150,000 effective July 1, 2026; the Clerk's probate pages still showed $75,000 when we read them on October 22, 2026.
- Creditors get three months. Most claims are barred unless filed within three months of the first published notice to creditors, and a two-year limit runs from the date of death.
- Homestead decides who signs. A surviving spouse or minor child limits who a Florida homestead can pass to, and the protected acreage differs inside and outside city limits.
- Expect a tax reset. Save Our Homes ends for most heirs on the January 1 after the change of ownership, so the Lake County tax bill can rise the next year.

Let's chatWhere does Lake County probate happen?
Lake County probate is handled by the Clerk of Court and Comptroller, Gary J. Cooney, at the Lake County Courthouse, 550 W. Main St., Tavares. The Clerk's office locations page lists probate, guardianship, and mental health among the services in the courthouse's East Wing, open 8:30 a.m. to 5 p.m. on weekdays.
Florida law puts Lake County in the Fifth Judicial Circuit along with Citrus, Hernando, Marion, and Sumter Counties (Fla. Stat. 26.021). Venue for a probate case is the county where the person who died was domiciled, not the county where the house sits (Fla. Stat. 733.101). That rule matters for heirs whose parent lived in one county and owned a house in another.
The Clerk also runs a South Lake Branch at 290 Citrus Tower Blvd., Suite 116, in Clermont and a North Lake Branch in The Villages of Lady Lake. Both list marriage licenses and passports as their services, not probate. Drop boxes in Clermont, Leesburg, and downtown Tavares deliver documents to the Clerk by the next business day, but the Clerk tells anyone facing a deadline to bring filings to the courthouse during business hours.
The first step often happens before any case is opened. Whoever holds the original will must deposit it with the Clerk within 10 days of learning of the death (Fla. Stat. 732.901).
| Filing | Lake County Clerk fee |
|---|---|
| Opening an estate (not including letters or a summary order) | $231 |
| Summary administration, estate under $1,000 | $235 |
| Summary administration, estate of $1,000 or more | $345 |
| Formal administration | $400 |
| Caveat or notice of trust | $41 |
| Reopening an estate | $50 |
Fees are from the Clerk's probate fee schedule, read October 22, 2026. Attorney, publication, and appraisal costs are separate.
Which Florida probate path fits an inherited Lake County house?
| Path | When it fits | What happens to the house |
|---|---|---|
| Summary administration | Estate of $150,000 or less after property exempt from creditors, or death more than 2 years ago, and the will does not require formal administration (Fla. Stat. 735.201) | The court orders the house to the heirs; they sell it themselves |
| Formal administration | Every estate that does not qualify for summary administration | A personal representative receives letters and sells under the will or with court approval |
| Disposition without administration | Only exempt personal property plus small personal property covering funeral and final medical costs (Fla. Stat. 735.301) | Not available for a house |
| No probate needed | House held in a trust, or with a co-owner under joint tenancy with right of survivorship | The trustee or surviving owner can generally sell without a probate case |
The summary threshold is new. Chapter 2026-57, Laws of Florida (CS/HB 1337, approved April 29, 2026) amended Fla. Stat. 735.201 to replace $75,000 with $150,000, effective July 1, 2026. When we read the Lake County Clerk's probate page on October 22, 2026, it still described summary administration as available for estates up to $75,000. The statute controls, but ask your attorney how the court is applying the change to deaths before July 1.
Summary administration has strings attached. Before the order is entered, the petitioner must search for creditors, serve them, and provide for payment where assets allow (Fla. Stat. 735.206). Heirs who receive property under the order stay personally liable for their share of valid claims, up to what they received, until claims are barred two years after the death. The same statute protects buyers: a bona fide purchaser from the heirs takes the house free of creditor claims.
The $150,000 test subtracts property exempt from creditors, and Article X, Section 4 of the Florida Constitution exempts a protected homestead and passes that protection to the surviving spouse or heirs. A parent's homestead can therefore fit summary administration even where Redfin's median runs well above $150,000, while a rental or second house is counted at its value. Whether a house qualifies as protected homestead is a question for a Florida probate attorney.
Can you sell an inherited house before probate closes in Lake County?
Yes, once someone has authority to sign. In formal administration, a personal representative whose will includes a power of sale can sell real property without court authorization or confirmation (Fla. Stat. 733.613). If the will is silent, or there is no will, the personal representative can still sell, but no title passes until the court authorizes or confirms the sale.
In summary administration, there is no personal representative. The court's order assigns the house to the heirs, and they sign the deed as owners. Because a buyer from those heirs takes free of creditor claims under Fla. Stat. 735.206, title companies can often insure that sale soon after the order is entered.
The creditor clock: three months, and a two-year backstop
In formal administration, the creditor window is the main reason a Lake County estate cannot close in a few weeks. The personal representative must publish a notice to creditors once a week for two consecutive weeks in a newspaper published in the county (Fla. Stat. 733.2121).
Most claims are barred unless filed by the later of three months after the first publication or 30 days after a creditor is served (Fla. Stat. 733.702). If the person who died was 55 or older, the personal representative must also serve the notice and a death certificate on Florida's Agency for Health Care Administration, the state Medicaid agency, within three months of first publication.
A second, absolute limit runs from the date of death. Two years after the death, the estate and the heirs are generally no longer liable for claims against the person who died, whether or not an estate was ever opened (Fla. Stat. 733.710). Neither deadline erases a recorded mortgage or lien, so a payoff still happens at closing.
Florida homestead: who can sell an inherited Lake County house
Under Article X, Section 4 of the Florida Constitution, a homestead cannot be left by will if the owner is survived by a spouse or a minor child, except that it can go to the spouse when there is no minor child. Fla. Stat. 732.4015 repeats that restriction and extends it to houses held in a revocable trust.
When a homestead passes outside a valid devise, Fla. Stat. 732.401 controls. If the owner left a spouse and descendants, the spouse takes a life estate and the descendants hold the remainder. The spouse can instead elect an undivided one-half interest as a tenant in common, but only within six months of the death. The result is often several owners of one house, all of whom must sign the deed.
The constitution measures protected homestead differently inside and outside a city. Outside a municipality it covers up to 160 acres of contiguous land; inside a municipality it covers up to one-half acre. The Lake County Property Appraiser lists 14 municipalities: Astatula, Clermont, Eustis, Fruitland Park, Groveland, Howey in the Hills, Lady Lake, Leesburg, Mascotte, Minneola, Montverde, Mount Dora, Tavares, and Umatilla. Yalaha and Grand Island are not on that list, so a rural acreage there is measured under the 160-acre rule.
Before closing an inherited homestead, Florida title companies usually ask for a probate court order determining homestead status. Starting that petition early keeps it from becoming the last item holding up a sale.
Lake County Property Appraiser: values, homestead, and the tax reset
The Lake County Property Appraiser, Mark V. Jordan, (352) 253-2150, is where heirs check the county's value and exemptions. Each parcel's online Property Record Card shows the assessed value, exemptions, and a working tax estimate, and the Sales Search tool lists recent recorded sales.
According to the Appraiser's exemptions page, a Lake County homestead exemption reduces assessed value by up to $51,411 and saves about $750 a year on average, varying by city millage. That exemption belongs to the owner who lived there. Heirs who do not move in will generally lose it, and the Appraiser says applications for a new exemption are due by March 1.
The larger change is the Save Our Homes cap. Fla. Stat. 193.155 limits yearly increases in a homestead's assessed value to the lower of 3 percent or the change in the Consumer Price Index. After a change of ownership, the house is reassessed at just value on the following January 1. Transfers to a surviving spouse, and transfers by law to a spouse or minor children under the homestead descent statute, are among the listed exceptions.
The Appraiser mails the TRIM notice, the official estimate of proposed taxes, in mid-August, and that is often when heirs first see the new number. The Appraiser's homepage also points owners to the Clerk's free Property Fraud Alert, which emails you when a document is recorded in a monitored name, a useful safeguard on a vacant inherited house.
Selling an inherited house town by town
The Florida rules above apply everywhere in the county, but the local details differ by town. The market figures below come from Redfin's city pages for the three months ending September 2026, read October 22, 2026; Redfin did not publish a city page we could read for Umatilla, Mascotte, Yalaha, or Grand Island, so none is shown.
| Place | County and probate court | Median sale price (Redfin) | Median days on market (Redfin) |
|---|---|---|---|
| Umatilla | Lake; Tavares courthouse | Not published | Not published |
| Tavares | Lake; Tavares courthouse | $315K, down 3.5% year over year | 77 days, from 70 |
| Mascotte | Lake; Tavares courthouse | Not published | Not published |
| Clermont | Lake; Tavares courthouse | $442K, down 4.0% | 52 days, from 36 |
| Yalaha (unincorporated) | Lake; Tavares courthouse | Not published | Not published |
| Grand Island (unincorporated) | Lake; Tavares courthouse | Not published | Not published |
| Minneola | Lake; Tavares courthouse | $484K, down 2.3% | 60 days, from 45 |
| Groveland | Lake; Tavares courthouse | $392K, up 4.5% | 54 days, from 55 |
| Ocoee | Orange; Ninth Judicial Circuit | $421K, down 5.0% | 68 days, from 38 |
Umatilla
Umatilla is a city in the north end of the county with its own City Hall at 1 South Central Ave. and its own code enforcement officer. The city's code enforcement page warns that replacing exterior windows or doors requires a permit and that after-the-fact permits carry double fees. Heirs planning repairs before a listing should pull permits first; heirs selling as-is can leave that work to the buyer.
Tavares
Tavares is the county seat, so heirs who live nearby can file at the courthouse in person. The city runs its own code enforcement special magistrate hearings, with one on the City of Tavares calendar for October 27, 2026, so a neglected vacant house inside city limits answers to the city. Tavares houses sold in a median 77 days over the three months ending September 2026, the slowest of the towns in the table (Redfin).
Mascotte
Mascotte is a south Lake County city whose City Hall at 100 E. Myers Blvd. keeps Monday to Thursday hours, 7 a.m. to 5:30 p.m., and closes Fridays, according to the city's permits page. Building permits are now filed through an online portal, which helps an heir who is managing repairs from another state. In May 2026 the city posted that Lake County is under a Water Shortage Order limiting residential irrigation to one day a week, a detail worth knowing when someone else is keeping up the lawn.
Clermont
Clermont is the busiest market in the table, with a median sale price of $442K and 285 sales in September 2026 (Redfin). The Clerk's South Lake Branch is at 290 Citrus Tower Blvd., but it handles marriage licenses and passports, so Clermont estates are still filed in Tavares. Days on market rose to 52 from 36 a year earlier, which lengthens the carrying period for an estate that lists. Our Clermont cash house buyer page covers local timelines.
Yalaha
Yalaha is an unincorporated community, not one of the 14 municipalities on the Property Appraiser's list. There is no city hall, so building and code questions go to Lake County government rather than a town office. Rural parcels here also fall under the constitution's 160-acre homestead measure, which can matter when an inherited house sits on acreage.
Grand Island
Grand Island is also unincorporated, so the same county-level rules apply: Lake County government for permits and code, the Tavares courthouse for probate, and the 160-acre homestead measure outside city limits. The Property Appraiser's Sales Search shows what nearby houses have sold for.
Minneola
Minneola had the highest median of the towns in the table, $484K, down 2.3% year over year, with houses selling in a median 60 days compared with 45 a year earlier (Redfin). A Minneola rental or second house at that price would count against the $150,000 summary threshold, while a protected homestead is subtracted from the test.
Groveland
Groveland was the only town in the table where the median rose, to $392K, up 4.5%, with a median of 54 days on market (Redfin). On October 20, 2026, the City of Groveland posted a police warning about callers posing as officers and demanding payment for fake warrants or unpaid court fees. Pay probate fees only to the Clerk of Court, through the channels on the Clerk's own fee page.
Ocoee is in Orange County
Ocoee is not in Lake County. It is in Orange County, which Fla. Stat. 26.021 places in the Ninth Judicial Circuit, so an estate for someone who lived in Ocoee is generally opened in Orange County. Ocoee's median was $421K, down 5.0%, with 68 days on market against 38 a year earlier (Redfin). Our guide to selling an inherited house in Orlando covers the Orange County process.
The same county rules apply in the smaller Lake County places heirs ask about, including Montverde, Astatula, Fruitland Park, Sorrento, Mount Plymouth, and Paisley.
Estate tax and capital gains on an inherited Lake County house
Most heirs owe no Florida estate tax on an inherited Lake County house. The Florida Department of Revenue says a federal change eliminated Florida's estate tax for people who died after December 31, 2004, and since July 1, 2023 personal representatives no longer file the Affidavit of No Florida Estate Tax Due.
The federal question is capital gains. The IRS says the basis of inherited property is generally its fair market value on the date of death. A house bought decades ago carries a basis close to its value at death, so a prompt sale often produces little taxable gain. A dated appraisal, or the Property Appraiser's sales data, helps document that value. Propcash does not give tax advice, so confirm with a tax professional.
Your options for selling an inherited house in Lake County
Once someone has authority to sign, heirs generally choose among three routes, and there is no rush to decide.
| Route | Typical timeline | Best when | What it asks of heirs |
|---|---|---|---|
| List with a local agent | A median 52 to 77 days on market in the Lake County towns above, plus closing (Redfin, three months ending September 2026) | The house shows well and someone local can manage it | Cleanout, repairs, showings, and commissions |
| Sell to a direct cash buyer | Can close in as few as 7 days once authority is in place | The house needs work, is full of belongings, or heirs live away | Take what you want and leave the rest; no repairs or showings |

Let's chatQuestions About Selling an Inherited House in Lake County
How do I sell an inherited house in Lake County, Florida?
Start with the Lake County Clerk of Court's probate section at the courthouse, 550 W. Main St. in Tavares, where the estate is opened if the person who died lived in Lake County. If the estate is worth $150,000 or less after exempt property, or the death was more than two years ago, summary administration can produce a court order that hands the house to the heirs, who can then sell it. Otherwise a personal representative is appointed in formal administration and can sell under a power of sale in the will, or with the court authorizing or confirming the sale. Either way, the house can often be sold before the estate is fully closed.
Where do I file probate for a house in Clermont, Minneola, Groveland, or Mascotte?
Probate for all four is filed in Tavares. The Clerk's South Lake Branch at 290 Citrus Tower Blvd. in Clermont handles marriage licenses and passports, and the Clerk lists probate among the services at the Lake County Courthouse in Tavares. Venue follows where the person lived, not where the house sits, so a Groveland house owned by someone domiciled in Lake County goes to the Lake County court.
Is Ocoee in Lake County for probate?
No. Ocoee is in Orange County, which Florida law places in the Ninth Judicial Circuit, while Lake County is in the Fifth. If the person who died lived in Ocoee, the estate is generally opened in Orange County, and our Orlando inherited-house guide covers that court. If the person lived in Lake County but owned a house in Ocoee, venue still follows where they lived, so the case would generally be filed in Tavares.
Does Florida's homestead rule stop heirs from selling an inherited Lake County house?
It does not stop a sale, but it decides who owns the house and therefore who must sign. Under Article X, Section 4 of the Florida Constitution and Florida Statute 732.4015, a homestead cannot be left by will away from a surviving spouse or minor child. If the owner left a spouse and descendants, the spouse generally takes a life estate with the remainder to the descendants, or can elect a one-half interest within six months of the death under Florida Statute 732.401. Title companies usually want the homestead question settled before they insure a sale.
Will the property tax bill go up after I inherit a house in Lake County?
It often does. Under Florida Statute 193.155, the Save Our Homes cap ends and the house is reassessed at just value on January 1 after a change of ownership, with exceptions for a surviving spouse and certain transfers to minor children. The Lake County Property Appraiser's online Property Record Card shows the current assessed value and exemptions, which helps heirs estimate the jump before the August TRIM notice arrives.
Can an out-of-state heir sell an inherited house in Umatilla or Tavares without traveling?
Often, yes. Florida title companies routinely close by mail, and the Clerk's probate fee schedule accepts mailed cashier's checks and money orders addressed to the Lake County Clerk's Office, ATTN: Probate, P.O. Box 7800, Tavares, FL 32778. If the person who died was not a Florida resident, an ancillary administration in Florida may be needed under Florida Statute 734.102, so confirm with a Florida probate attorney. Propcash buys inherited houses as-is, so heirs can take what they want and leave the rest without arranging a cleanout from out of state.
Propcash is a direct cash homebuyer, not a law firm or a tax advisor, and we wrote this page. Florida probate procedure, homestead rules, and tax assessments are set by statute and applied by the Lake County court and Property Appraiser. Sources were read on October 22, 2026.
