Selling a Joplin Rental House With Tenants in Place: Leases, Deposits, and Your Options

Wooden blocks spelling rental beside a model house and a roll of cash

You can sell a Joplin rental with tenants in place, and the buyer takes over the lease.

Because RSMo 535.300 never mentions a new owner, the lease and the purchase contract usually decide how deposits move, often as a credit at closing.

This is general information, not legal advice. State rules vary.

If you want to sell rental property in Joplin, MO, the tenants can usually stay where they are. What trips sellers up is the security deposit, because the statute often cited online does not say what they think it says.

This guide covers the Missouri statutes on leases, deposits, and rent at a sale, the Joplin rules, the 2026 numbers, and five ways to sell a house with tenants in Missouri.

Does selling a Joplin rental end the lease?

Selling a Joplin rental generally does not end the lease. Under Missouri law, the buyer of an occupied house steps into the existing lease, so the tenant stays on the same terms.

That statute is RSMo 535.070. It applies when someone buys a house "occupied at the time of such purchase by any tenant." It covers a private sale, a foreclosure, or a tax sale alike.

"[T]he person purchasing such property shall have the right ... to commence proceedings before an associate circuit judge to recover rent and possession, under the terms of the prior owner's lease, for unpaid rent accruing after the transfer of title."

RSMo 535.070, the Missouri statute on buyers of leased property

A second statute removes the need for the tenant's sign-off. Under RSMo 441.140, a grant of land or a lease term is effective "without the consent of the tenants; unless otherwise stated in the lease."

The lease's own sale clause

Some leases carry a sale clause that lets a new owner end the lease early with notice. Others say nothing. The written lease is the first document to read before you list.

  • Fixed-term lease, no sale clause: generally binds the buyer until the end date.
  • Fixed-term lease with a sale clause: the clause's notice terms usually control.
  • No signed written lease: treated as month to month under RSMo 441.060.

Month-to-month tenancies

A month-to-month tenancy ends with written notice under RSMo 441.060. The notice must name "a periodic rent-paying date not less than one month after the receipt of the notice." Either the landlord or the tenant can give it.

For a seller who wants the house empty, this is the shortest path that needs no court.

What does Missouri law say about deposits at a sale?

Missouri's security deposit statute says nothing about a sale. RSMo 535.300 sets a cap, a holding rule, and a return deadline, but it never mentions a new owner, a buyer, or a transfer.

We read the full text on revisor.mo.gov on November 6, 2026. Several search results claim it requires the seller to pass deposits to the buyer. It does not.

What RSMo 535.300 does say

  • Cap: a landlord "may not demand or receive a security deposit in excess of two months' rent."
  • Holding: deposits sit in a bank, credit union, or depository institution insured by a federal agency.
  • Return: within 30 days after the tenancy ends, the landlord returns the deposit or mails an itemized list of damages with the balance.
  • Penalty: a tenant recovers "twice the amount wrongfully withheld."
  • Pet deposits: excluded from the definition of a security deposit.

Who decides the handoff

Buyers and sellers often handle deposits as a credit at closing: the seller keeps the cash and the buyer takes a price reduction equal to the deposits. The buyer then owes the 30-day return when each tenancy ends.

We found no other Missouri statute that addresses deposits when a landlord sells. A written deposit ledger gives both sides one number to credit.

Why the paper trail matters

The 535.300 penalty is double the amount wrongfully withheld. A signed closing statement showing the deposit credit is the clearest record if a tenant later asks who holds it.

After a Missouri sale, the buyer notifies tenants in writing that title has transferred (RSMo 535.081).

What transfers to the buyer at closing

At closing, the lease and the right to future rent pass to the buyer by statute, while deposits, prepaid rent, and keys pass on the terms of the purchase contract. The table sets out each item and its source.

Item What happens at a sale Source
The lease Buyer collects rent under the prior owner's lease; no tenant consent needed unless the lease says so RSMo 535.070 and 441.140
Security deposits Statute is silent; often credited to the buyer at closing Contract decides (535.300 is silent)
Rent paid before the tenant hears of the sale The tenant is protected for that payment RSMo 441.140
Rent paid to the seller after the transfer The buyer may recover it from the seller RSMo 441.130
Prepaid rent for the closing month Usually split by day on the closing statement Contract decides
Notice to tenants Buyer gives written notice of the transfer with a recorded deed copy or, in some counties, a joint affidavit RSMo 535.081
Keys, garage remotes, and codes Handed over at or after closing Contract decides

The buyer's notice to tenants

The buyer's right to collect rent "requires adequate and timely notice to the tenant," under RSMo 535.081. The notice states that title transferred, how, and on what date. It travels with a copy of the recorded deed.

In counties of the first classification, the statute allows a notarized affidavit signed by both the old and new owner instead of the deed copy. The title company closing the sale can confirm which form fits the county where the house sits.

Joplin rental rules a seller can check

A search of the City of Joplin's website on November 6, 2026 found a short-term rental permit and license, but no citywide long-term rental license. A standard 12-month or month-to-month rental does not appear to need a city rental license to be sold.

KOAM reported on January 17, 2022 that a new ordinance required a permit and license for every short-term rental, starting January 24. The City keeps its forms on its short-term rentals page.

Code enforcement still applies

No rental license does not mean no oversight. The City's code enforcement process sets a goal of inspecting each parcel four times a year.

An open violation letter can follow a rental into a sale. Our guide to selling a Joplin house with code violations walks through the letter, the re-inspection, and the Municipal Court step.

Which county the house sits in

Joplin, Missouri sits in two counties: mostly Jasper, with the southern part in Newton. ZIP 64804 spans both, so the parcel record decides which county's collector and court apply.

At Joplin's median gross rent of $962 a month, each month a rental sits empty costs close to $1,000 in lost rent (Census ACS, 2020-2024).

The 2026 numbers for rental property in Joplin, MO

Joplin is a renter-heavy city: 46.6% of its occupied housing units are rented, and the median gross rent is $962 a month (Census ACS, 2020-2024 five-year estimates).

  • Days on market: a median of 34 days, up from 23 a year earlier, for the three months ending September 2026 (Redfin, September 2026).
  • Median sale price: $177,416, up 7.6% year over year, same window (Redfin, September 2026).
  • Housing age: 46.3% of Joplin's housing units were built before 1980 (Census ACS, 2020-2024).

For a landlord, days on market is the number to watch. An emptied house carries taxes, insurance, and utilities with no rent; at the $962 median, each lost month is close to $1,000.

The federal lead rule for older rentals

A house built before 1978 carries a federal lead-based paint disclosure at sale. EPA's real estate disclosure page says sellers must disclose known lead-based paint and hazards, give buyers the "Protect Your Family From Lead In Your Home" pamphlet, and provide available records.

Jasper County has its own well and soil rules that can come up at a sale. Our guide to the Jasper County well test and lead notice covers them.

Methamphetamine disclosure

Missouri also requires a seller or landlord who knows a house was used to produce methamphetamine to disclose it in writing (RSMo 441.236). A landlord selling a former rental is covered by that rule.

Problem tenants and the county court

A rent case or unlawful detainer case against a Joplin tenant goes to an associate circuit judge in the county where the house sits. That is Jasper County or Newton County, depending on the parcel.

The rent and possession process starts at RSMo 535.010 and runs through 535.300. RSMo 535.020 sends the filing to "any associate circuit judge in the county in which the property is situated." Unlawful detainer cases under chapter 534 follow the same county rule in RSMo 534.060.

Timing of a rent case

Under RSMo 535.030, the summons in a rent case carries a court date no more than 21 business days after it is issued, unless the landlord agrees in writing to a later date. The 441.060 notice is not required before filing for unpaid rent, per 535.020.

No self-help

Missouri rules out lockouts and shutoffs. Under RSMo 441.233, removing a tenant without judicial process and a court order, or cutting electric, gas, water, or sewer service, counts as forcible entry and detainer.

Five ways to sell a tired landlord's Joplin rental

A tired landlord in Joplin has five main paths: sell with tenants in place, gather estoppel letters, offer cash for keys, wait out the lease, or sell vacant. Each trades time against rent.

Factor Sell with tenants in place Sell vacant
Time before listing None for the lease; the buyer takes it over Lease end date, or at least one month's notice for month to month (RSMo 441.060)
Time on market Depends on the buyer; a direct cash sale can close in as few as 7 days after the contract is signed Joplin median of 34 days on market (Redfin, September 2026), plus closing
Showings Set by the lease's entry terms and the tenant's schedule Open whenever the seller allows
Notice rules Buyer's transfer notice after closing (RSMo 535.081) Seller's termination notice before the sale (RSMo 441.060)
Rent while selling Keeps coming in until closing Stops; the seller carries taxes, insurance, and utilities
Deposits Often credited to the buyer at closing Returned or itemized within 30 days of move-out (RSMo 535.300)

1. Sell with tenants in place

The house sells as a working rental, usually to another landlord or a cash buyer.

2. Line up tenant estoppel letters

An estoppel letter is a short statement each tenant signs, confirming the rent, the deposit, the lease end date, and any side deals. Buyers often ask for one because the seller's rent roll is the seller's word. With a signed letter, the deposit credit and the rent proration rest on numbers the tenant has also confirmed.

3. Offer cash for keys

A cash-for-keys agreement is a voluntary written deal: the tenant moves out by a set date, leaves the house broom clean, and receives a payment. We found no Missouri statute that governs these agreements, so the written terms are the whole deal. A tenant can decline, and the no-self-help rule in 441.233 still applies.

4. Wait for the lease to end

Waiting costs nothing in legal terms. The cost is time: the lease runs out, then make-ready work, then the 34-day median on market.

5. Sell vacant

An empty house opens the sale to buyers who plan to live in it. It also means turnover repairs, open showings, and months with no rent. For a pre-1978 house, the lead disclosure applies either way.

Frequently Asked Questions

Does Missouri's deposit statute require the seller to hand deposits to the buyer?

Missouri's security deposit statute, RSMo 535.300, does not mention a sale or a new owner at all. It caps deposits at two months' rent and sets the 30-day return rule after a tenancy ends. The handoff at a sale is usually set by the lease and the purchase contract, and buyers and sellers often handle it as a credit at closing.

How much notice does a Missouri month-to-month tenant get after a sale?

A month-to-month tenancy in Missouri ends with written notice naming a rent-paying date at least one month after the tenant receives it, under RSMo 441.060. A sale does not shorten that notice. The owner on the date the notice is given, seller or buyer, is the one who gives it.

Who collects rent after a Joplin rental closes?

The buyer collects rent after closing, under the terms of the prior owner's lease, according to RSMo 535.070. Before the buyer can sue for unpaid rent, RSMo 535.081 requires written notice to each tenant that title has transferred. A tenant who pays the old owner before getting notice is protected for that payment under RSMo 441.140.

Is a cash-for-keys agreement required to empty a rental before a sale?

A cash-for-keys agreement is never required in Missouri, and we found no Missouri statute that governs one. It is a voluntary written deal in which a tenant agrees to move out by a set date in exchange for a payment. A tenant can say no, and the landlord cannot use lockouts or utility shutoffs instead, which RSMo 441.233 treats as forcible entry and detainer.

Does a Joplin rental need a city license before it can be sold?

A search of the City of Joplin's website on November 6, 2026 turned up a short-term rental permit and license but no citywide long-term rental license. Code enforcement still applies to rented houses, so an open violation letter can follow the house into a sale. The City's Neighborhood Services division can confirm what applies to a specific address.

Can Propcash buy a Joplin rental with tenants still living there?

Propcash may buy a Joplin rental with tenants in place, so no eviction is needed before you sell. The leases, rent roll, and deposit ledger shape the cash offer, and the reasoning behind the number is shown. Closing can take as few as 7 days after the contract is signed, on a date the seller picks.
